1. Data Controller

The data controller within the meaning of the General Data Protection Regulation (GDPR) is:

2. Collection and Storage of Personal Data

When Visiting the Website

When you access our website, your browser automatically transmits information to our server. This information is temporarily stored in what are known as server log files:

  • IP address of the requesting device (anonymized)
  • Date and time of access
  • Name and URL of the file retrieved
  • Browser used and, where applicable, the operating system

This data is collected and processed on the basis of Art. 6(1)(f) GDPR (legitimate interest) for the purpose of ensuring smooth operation of our website and improving our offering. The data is deleted after 7 days at the latest.

3. Contact Form & Configurator

If you contact us via the contact form or the offer configurator on our website, the data you provide (name, email address, company if applicable, message, and your configurator entries) is stored for the purpose of processing your inquiry.

The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures) as well as Art. 6(1)(f) GDPR (legitimate interest in responding to inquiries).

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected, but no later than after 24 months.

4. Newsletter

You can subscribe to our newsletter on our website. Signing up requires entering your email address and actively ticking a checkbox, by which you give your explicit consent. Your consent is documented in our database together with a timestamp and technical information (browser identifier).

We store your email address, the time of sign-up, and the text of the consent given. The legal basis is your consent pursuant to Art. 6(1)(a) GDPR.

You can withdraw your consent at any time with effect for the future by sending us an email at mail@defyne.de. The data is deleted after withdrawal.

5. Firebase / Google Cloud (Storage of Inquiries)

To store contact inquiries and configurator results, we use Firebase Firestore, a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

When you submit a form, the data you entered is stored in the Firebase database. Firebase stores data in Google data centers, which, depending on configuration, may be located in the EU or the USA. For data transfers to the USA, we rely on the European Commission's Standard Contractual Clauses (Art. 46(2)(c) GDPR) as well as the EU-US Data Privacy Framework.

The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures) as well as Art. 6(1)(f) GDPR (legitimate interest in secure and reliable storage of inquiries).

In addition, when the page loads, the Firebase JavaScript SDK is loaded from Google's servers (gstatic.com), whereby your IP address is transmitted to Google. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in the secure operation of the web application).

6. EmailJS (Email Delivery)

To send confirmation and notification emails (e.g., for newsletter sign-ups and contact inquiries), we use the service EmailJS, provided by EmailJS Ltd., 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

When you submit a form, the data you entered (e.g., email address, name, message) is transmitted via the EmailJS API to deliver the email. This data is processed by EmailJS and is not stored permanently. For data transfers to third countries, we rely on the European Commission's Standard Contractual Clauses (Art. 46(2)(c) GDPR).

The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures) as well as Art. 6(1)(a) GDPR (consent) for the newsletter. Further information: emailjs.com/legal/privacy-policy

The EmailJS script is loaded via the Content Delivery Network (CDN) of jsDelivr (Prospect One, Królewska 65A/1, 30-081 Kraków, Poland). In doing so, your IP address is transmitted to jsDelivr. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in the efficient and secure loading of scripts). Further information: jsdelivr.com/privacy-policy

7. Cookies

Our website uses only technically necessary cookies required for the operation of the site. These cookies do not store any personal data and are automatically deleted at the end of the browser session.

We do not use tracking cookies, third-party analytics tools (e.g., Google Analytics), or social media plugins that transmit data without your consent.

8. Your Rights

You have the following rights with respect to us regarding the personal data concerning you:

You also have the right to lodge a complaint with a data protection supervisory authority regarding the processing of your personal data. The competent supervisory authority is the Landesbeauftragte für den Datenschutz und die Informationsfreiheit Rheinland-Pfalz (State Commissioner for Data Protection and Freedom of Information of Rhineland-Palatinate).

9. Disclosure of Data

Your personal data is not transmitted to third parties for purposes other than those listed below.

We only disclose your personal data to third parties if this is necessary for the performance of a contract (Art. 6(1)(b) GDPR), you have given your explicit consent (Art. 6(1)(a) GDPR), or we are legally obligated to do so (Art. 6(1)(c) GDPR).

10. Data Security

We take appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, or destruction. Our website is delivered via an encrypted HTTPS connection.

11. Changes to This Privacy Policy

We reserve the right to amend this privacy policy to ensure it always complies with current legal requirements or to reflect changes to our services, e.g., when introducing new features. The revised privacy policy will apply to your next visit.
